1.1 All offers, orders, and agreements made using the Innovaskin Solutions website are exclusively subject to these General Conditions (hereinafter: conditions), to the exclusion of any other general conditions.
1.2 Accepting an offer or placing an order constitutes acceptance of the applicability of these conditions.
1.3 Any deviations from these conditions can only be made in writing. If a part of these conditions is deviated from, the remaining provisions will remain in full force.
2.1 An agreement is concluded after acceptance of the customer's order by Innovaskin Solutions. This can be a physical or online order.
2.2 Innovaskin Solutions is entitled to refuse orders or request additional information. If an order is not accepted, this will be communicated to the customer with the reason.
3.1 The prices mentioned with the articles are in euros. Shipping costs and any cash on delivery charges are not included in the prices mentioned unless otherwise stated.
3.2 The shipping costs for orders are EUR 6.95 within Belgium and EUR 8.95 for the Netherlands. For cash on delivery, a surcharge of EUR 13.95 applies. These prices are excluding VAT.
3.3 Innovaskin Solutions cannot be held to price quotations that are evidently incorrect, for example, as a result of obvious input, composition, or printing errors. No rights can be derived from unlawful price information.
3.4 Prices for all products and services are subject to change. Innovaskin Solutions has the right to change prices and is not obliged to inform about this. Price changes occur once a year.
4.1 Payment can be made in the manner(s) indicated during the order process. Additional (payment/order) conditions may be imposed on the customer's order.
4.2 After placing an order, the customer immediately receives a confirmation by email with the total cost, including shipping costs. Payment is always made in advance or in cash on delivery.
4.3 Payment is possible by:
a) Cash on delivery: you order and pay to the deliverer upon delivery.
b) iDeal: if you bank online with Rabobank, ABN AMRO, or ING (Postbank), you can arrange the payment of your order securely via our site. An electronic payment via the Internet is comparable to a PIN payment in the store. After placing your order, you choose the iDeal payment method. A screen opens where you can choose the bank where you do your online banking. You then follow the procedure you are used to with internet banking payments. In principle, the payment is processed the same working day.
4.4 In the case of payment in advance by bank or giro transfer, payment must be fully received by Innovaskin Solutions within seven (7) days of the order date, after which the order will be shipped.
4.5 The customer authorizes Innovaskin Solutions to perform all necessary actions to allow payment to take place in the manner chosen by the customer.
4.6 For payment by bank or giro, the date of payment is the date of crediting the bank account of Innovaskin Solutions.
5.1 Innovaskin Solutions strives to deliver orders within 1-2 working days after receipt of payment unless a longer delivery period has been agreed. However, Innovaskin Solutions is not obliged to deliver within this period.
5.2 Innovaskin Solutions is obliged to deliver within thirty (30) days of receipt of your order unless a longer delivery period has been agreed. If this is not possible (order temporarily out of stock) or for other reasons, or if an order can only be partially executed, the customer will be informed within a maximum of three (3) weeks after placing the order, and the customer will have the right to cancel the order without costs.
5.3 Color, type, text, and/or price changes reserved. The goods and/or services offered are clearly and truthfully represented and/or described as fully as reason requires, with the commercial intent clearly apparent.
6.1 The ownership of delivered products is only transferred when the customer has paid everything owed to Innovaskin Solutions under the agreements concluded regarding the delivered products.
7.1 We do everything possible to deliver a perfect product. If an article nevertheless does not meet your expectations, you must send an email to info@innovaskin-solutions.be within three (3) working days of receiving the order. We will resolve the issue as soon as possible, but no later than within 3 days, in consultation with you. If this does not succeed within 3 days, we will inform you.
7.2 To ensure smooth handling of your complaint, we ask you to strictly follow our instructions. The postage costs for returning an article with a complaint are initially borne by the customer. These costs will be credited if the complaint is justified.
7.3 If the offered solution does not meet your expectations, you can cancel the entire order within five (5) working days, without additional costs. The amount already paid will be credited immediately, as described in article 8.6. This guarantee expires when:
a) articles have been worn or used,
b) you have attempted to repair the defect yourself,
c) you have not followed the instructions and/or user instructions.
8.1 Innovaskin Solutions is not liable for misunderstandings, mutilations, delays, or incorrect transmission of orders and communications resulting from the use of the Internet or any other communication medium in the interaction between the customer and Innovaskin Solutions, or between Innovaskin Solutions and third parties, insofar as it concerns the relationship between the customer and Innovaskin Solutions, unless and insofar as there is intent or gross negligence on the part of Innovaskin Solutions.
9.1 In the event of force majeure, Innovaskin Solutions has the right, at its discretion, to suspend the execution of the customer's order or to dissolve the agreement without judicial intervention, by informing the customer in writing, and without Innovaskin Solutions being obliged to pay any compensation, unless this is unacceptable according to standards of reasonableness and fairness.
10.1 All rights, obligations, offers, orders, and agreements to which these conditions apply, as well as these conditions themselves, are exclusively governed by Belgian law.
10.2 If one or more provisions of these conditions are declared invalid by judicial decision, the other provisions of these general conditions will remain in full force, and Innovaskin Solutions and the client will consult to agree on new provisions to replace the invalid or annulled provisions, taking into account as much as possible the aim and intent of the invalid or annulled provisions.
10.3 Disputes can be submitted to the competent court in Belgium.
11.1 Innovaskin Solutions vouchers can only be redeemed on and via the Innovaskin Solutions website.
11.2 The discount is given on the total amount of the ordered products excluding shipping costs, any cash on delivery charges, or other additional costs.
11.3 Vouchers are not valid in combination with other promotions and/or (sponsor) offers.
11.4 Only one voucher can be redeemed per order.
12.1 The warranty period for all equipment is one year full manufacturer/assembly warranty + one year incomplete warranty, which means that in case of repair, you only pay for the relevant part and not for the assembly/work hours of the technician from the date of purchase.
12.2 During the warranty period, Innovaskin Solutions covers the costs for repairing or replacing defective parts.
12.3 Defective products or parts for which replacement products or replacement parts have been provided by Innovaskin Solutions to the buyer become the property of Innovaskin Solutions.
12.4 If Innovaskin Solutions fails to restore the product to good working order after repeated efforts, Innovaskin Solutions is entitled to replace the product with an identical or functionally equivalent product.
12.5 This warranty does not provide other recourse or remedies for the buyer than those mentioned in this document. The warranty does not include, for example, compensation for incidental damage, consequential damage, or any other forms of damage or loss.
12.6 Not covered by this warranty:
a) Products or parts with a limited lifespan or that can be considered consumables, such as contact gel, demineralized water, membranes.
b) Defects resulting from user non-compliance with the instructions in the manual or technical and/or safety standards.
c) Defects resulting from accidents, fire, negligence, misuse, wear and tear, incorrect installation, the introduction of liquids or other foreign substances into the product, such as power sources, circuit boards, electric motors, pumps, for example, by transporting equipment with a full water tank and/or not emptying the cryolipolysis filter in time, or defects that occur during transport to or from the buyer.
d) Defects caused by using parts or accessories of a brand other than Innovaskin Solutions or caused by modifying, repairing, or disassembling the product by a person not authorized by Innovaskin Solutions to perform such actions.
e) If the warranty sticker(s) is/are broken.
f) If no maintenance has been performed (exclusively by Innovaskin Solutions within the set period). The set period for all equipment supplied by Innovaskin Solutions is at least once every 12 months.
g) If water filters or other filters have not been replaced in time.
12.7 In the unlikely event that your product breaks down, consult the supplied user manual. If you believe your product is defective, contact the authorized supplier who sold you the product or the nearest authorized service center directly. You must be able to provide this sales contract as well as your proof of purchase with the purchase date.
12.8 If equipment breaks down within (or after) the mentioned warranty period, the buyer must take care of the transport of the device to the Innovaskin Solutions facility at their own risk. This also applies if equipment has been previously delivered to the buyer's address.
12.9 This warranty only applies to products that were purchased and used exclusively in the European Union and Switzerland. If the product was not marketed by Innovaskin Solutions in the country where it was used, it may be necessary to obtain replacement parts from a country where the product was originally marketed or to have the repair carried out in a country where the product was originally marketed. In both cases, the buyer must be able to provide this sales contract as well as their proof of purchase with the purchase date. Any transport, both of the product and any replacement parts, is at the buyer's expense and risk and may lead to delays in the repair process.
12.10 Innovaskin Solutions is never obliged to pay any compensation to the buyer or others unless there is intent or gross negligence on its part.
12.11 Innovaskin Solutions does not provide any result guarantee on treatments performed with equipment purchased from Innovaskin Solutions.
12.12 Innovaskin Solutions accepts no liability in any case for consequential or business damage, indirect damage, and loss of profit or turnover.
