1.Parties, scope and contract documents
The seller is Innovaskin Solutions, Diamantstraat 8 bus 379, 2200 Herentals, Belgium, info@innovaskin-solutions.be. This order agreement, the product information, checkout summary, order confirmation and invoice together form the agreement for the relevant order.
If documents conflict, order-specific information on the product, quantity, price and delivery prevails over general descriptions in this agreement. Mandatory statutory rights always remain applicable.
2.Products and formation of the order
The order comprises the accessories, consumables, spare parts or other webshop items listed in the order confirmation. The agreement is formed when Innovaskin Solutions confirms the order electronically.
Obvious pricing, stock or product errors may be corrected before dispatch. If a material correction is required, the customer may accept the amended order or cancel it without charge.
3.Price, taxes and payment
Before the payment action, checkout displays the applicable price, taxes, discount and delivery costs. The total shown in the order confirmation and invoice is payable through the stated payment method and by the stated due date.
Payment is final only after confirmation by the payment provider or receipt in the communicated bank account. A valid VAT reverse charge is stated on the invoice.
4.Delivery, risk and inspection
The available delivery method, delivery charge and any delivery restriction are communicated during checkout. A stated delivery time is an estimate unless expressly confirmed in writing as binding.
Inspect the shipment on receipt and report visible transport damage as soon as possible with photos and the order reference. Prompt notice helps the investigation but does not limit mandatory statutory rights.
5.Use of accessories and consumables
Use products only for their stated purpose and in accordance with product, safety, storage and maintenance instructions. Normal wear, consumption through use or damage caused by misuse is not in itself a lack of conformity.
Use of unapproved parts or consumables may cause damage. An exclusion applies only to the extent that such use actually caused the reported problem.
6.Privacy and electronic communication
Personal data is processed to perform the order, deliver products, provide customer service, keep accounts and comply with legal obligations. Further information is available in the privacy statement on the website.
The customer accepts that order confirmations, invoices and contract documents are provided electronically. This PDF is a durable copy of the accepted order agreement.
7.14-calendar-day right of withdrawal
A consumer may in principle withdraw from an online purchase without giving a reason within 14 calendar days from the day after receiving the goods. For separate deliveries within one order, the period starts after receipt of the last item.
To withdraw, an unequivocal statement by email or post to Innovaskin Solutions before the period expires is sufficient. The model form below may be used but is not mandatory.
The consumer must return the goods no later than 14 days after giving notice of withdrawal. The direct return costs are borne by the consumer unless Innovaskin Solutions confirms in writing that it will bear them. The consumer is liable only for diminished value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
Innovaskin Solutions reimburses the amounts received, including the least expensive standard delivery offered, no later than 14 days after notice of withdrawal and through the same payment method. For goods, reimbursement may be withheld until the goods are received back or evidence of dispatch is provided.
8.Statutory exceptions to withdrawal
The right of withdrawal does not apply in statutory exception cases, including goods made to the consumer’s specifications or clearly personalised, goods liable to deteriorate or expire rapidly, and sealed goods not suitable for return for health protection or hygiene reasons if unsealed after delivery.
An exception is applied only where the specific nature and condition of the ordered product meet the statutory requirements. Being a consumable does not by itself remove the right of withdrawal.
9.Statutory conformity guarantee
New consumer goods benefit from the Belgian two-year statutory conformity guarantee from delivery. Innovaskin Solutions, as the final seller, is the point of contact for a lack of conformity.
For a covered lack of conformity, the statutory remedies apply, including free repair or replacement and, where the statutory conditions are met, price reduction or termination. A manufacturer’s or commercial guarantee may add to but cannot restrict these rights.
10.Liability and force majeure
No provision limits liability or rights that cannot be excluded under mandatory consumer law. Innovaskin Solutions is not liable for damage demonstrably caused by misuse, unauthorised alterations or failure to follow clear safety and maintenance instructions.
An event beyond reasonable control suspends the affected obligations for the duration of the impediment. The consumer retains all mandatory rights applicable in that situation.
11.Complaints, governing law and disputes
Questions or complaints may be submitted with the order reference to info@innovaskin-solutions.be. The parties will first try to reach an amicable solution.
Belgian law applies, without prejudice to mandatory protection available to the consumer in the country of their habitual residence. The court having jurisdiction under applicable law is competent.
